What is a cookie?

Based on ownership:

Depending on their purpose:

  • Technical cookies: these are cookies that allow the user to navigate a website, platform, or application and use the various options or services available on it, including those that the publisher uses to manage and operate the website and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remember the items included in an order, complete the purchase process for an order, manage payment, control fraud related to service security, process registration or participation requests for an event, count visits for the purpose of billing software licenses used by the service (website, platform, or application), using security features while browsing, storing content for the streaming of videos or audio, enabling dynamic content (for example, loading animations for text or images), or sharing content via social media.

Also falling into this category, due to their technical nature, are cookies that enable the most efficient management of advertising spaces which, as another element of the design or “layout” of the service offered to the user, the publisher has included on a website, application, or platform based on criteria such as the published content, without collecting user information for other purposes, such as personalizing that advertising content or other content. Technical cookies are exempt from compliance with the obligations set forth in Article 22.2 of the LSSI when they enable the provision of the service requested by the user, as is the case with the cookies listed in the preceding paragraphs.   • Preference or personalization cookies: these are cookies that store information so that the user can access the service with specific settings that may differentiate their experience from that of other users, such as the language, the number of results displayed when the user performs a search, the appearance or content of the service based on the type of browser used to access the service or the region from which the user accesses the service, etc.

If the user selects these features themselves (for example, by selecting a website’s language by clicking on the corresponding country’s flag icon), the cookies are exempt from the requirements of Article 22.2 of the LSSI, as they are considered a service expressly requested by the user, provided that the cookies serve exclusively the selected purpose.

  • Analytics or measurement cookies: These cookies allow the party responsible for them to track and analyze the behavior of users on the websites to which they are linked, including measuring the impact of advertisements. The information collected through these cookies is used to measure activity on websites, applications, or platforms, with the aim of making improvements based on the analysis of how users interact with the service. 

With regard to the processing of data collected through analytics cookies, although they are not exempt from the requirement to obtain informed consent for their use, it is unlikely that they pose a risk to users’ privacy provided that they are first-party cookies, process aggregated data for strictly statistical purposes, provide information about their use, and include the option for users to opt out of their use.

  • Behavioral advertising cookies: These are cookies that store information about user behavior obtained through the continuous monitoring of their browsing habits, which allows for the creation of a specific profile to display advertising tailored to that profile.

Depending on how long they remain active on the end device, we can distinguish between:

  • Session cookies: These are cookies designed to collect and store data while the user is visiting a website. They are typically used to store information that is only needed to provide the service requested by the user on a single occasion (for example, a list of purchased items) and are deleted when the session ends.

These tools do not collect personal data from users or the IP address from which they connect.
